By downloading, installing, or using HomeProjectPro.AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. DESCRIPTION OF SERVICE

What HomeProjectPro.AI Provides

HomeProjectPro.AI is a mobile application that helps homeowners:

• Manage DIY project planning and tracking

• Track home improvement inventory

• Create and manage shopping lists

• Access preset project guides and learning paths

• Utilize AI-powered product recommendations (Pro/Premium tiers)

• Organize home maintenance tasks

Service Tiers

FREE TIER:

• Up to 20 inventory items

• Up to 3 active projects

• Access to 10 basic project guides

• No AI features

PRO TIER ($4.99/month or $39/year):

• Unlimited inventory items

• Up to 10 active projects

• Access to all 50+ project guides

• 3 AI project generations per month

• 5 AI product enhancements per month

• AI explanations enabled

• Email support (48-hour response)

PREMIUM TIER ($9.99/month or $79/year):

• Unlimited inventory items

• Unlimited active projects

• All project guides + exclusive content

• Unlimited AI features

• Priority support (12-hour response)

• Cloud backup and sync (when available)

2. ELIGIBILITY

You must be at least 13 years old to use HomeProjectPro.AI.

By using the App, you represent and warrant that:

• You are at least 13 years of age

• You have the legal capacity to enter into these Terms

• You will comply with all applicable laws and regulations

3. ACCOUNT AND REGISTRATION

Account Creation

• No account required for basic features

• Optional profile information (name, email) for enhanced experience

• You are responsible for maintaining confidentiality of your data

Accurate Information

You agree to provide accurate and complete information when using the App.

4. SUBSCRIPTIONS AND PAYMENTS

Subscription Terms

AUTO-RENEWAL:

• Subscriptions automatically renew unless canceled

• Renewal charge occurs 24 hours before the end of the current period

• Cancel anytime in your device's subscription settings

PAYMENT PROCESSING:

• Payments processed through Apple App Store or Google Play Store

• Pricing displayed in your local currency

• Prices subject to change with 30 days notice

Subscription Changes

UPGRADING:

• Upgrade takes effect immediately

• Prorated credit applied to current billing cycle

• New features unlock immediately

DOWNGRADING:

• Downgrade takes effect at end of current billing period

• Data beyond new tier limits not deleted, but access may be restricted

• No refunds for unused portion of higher tier

CANCELLATION:

• Cancel anytime via App Store or Google Play settings

• Access continues until end of paid period

• No refunds for partial periods (see Refund Policy)

Pricing Changes

We reserve the right to modify subscription prices with 30 days notice. Existing subscribers keep current pricing until next renewal cycle.

5. REFUND POLICY

General Refund Policy

APP STORE (iOS):

• Refund requests handled by Apple

• Submit refund request via Apple: reportaproblem.apple.com

• We do not control Apple's refund decisions

GOOGLE PLAY (Android):

• Refund requests handled by Google

• Request refund via Google Play within 48 hours of purchase

• After 48 hours, contact us at support@homeprojectpro.ai

Our Refund Policy

We may offer refunds at our discretion for:

• Technical issues preventing app use

• Billing errors

• Accidental purchases

We generally do NOT refund:

• Change of mind

• Failure to use the service

• Failure to cancel before renewal

• Violation of these Terms

6. USER CONDUCT

You Agree NOT To:

• Use the App for any unlawful purpose

• Attempt to gain unauthorized access to the App or its systems

• Reverse engineer, decompile, or disassemble the App

• Remove or modify any copyright or proprietary notices

• Use the App in any way that could harm or interfere with the App

• Share your subscription with others (except family sharing via Apple/Google)

• Use automated systems (bots, scrapers) to access the App

• Misuse AI features to generate harmful or inappropriate content

• Violate any applicable laws or regulations

Consequences of Violation

We reserve the right to:

• Suspend or terminate your access

• Remove your data

• Report violations to law enforcement

• Take legal action

7. INTELLECTUAL PROPERTY

Our Ownership

All content in HomeProjectPro.AI is owned by us or our licensors:

• App code and design

• Preset project guides

• Learning paths

• Glossary content

• Logos and branding

• AI-generated content

Protected by copyright, trademark, and other intellectual property laws.

Your Content

CONTENT YOU CREATE:

• Projects, inventory, notes, and shopping lists

• You retain ownership of your user-generated content

• You grant us a license to store and process your content to provide the service

• This license terminates when you delete your content or the app

AI-GENERATED CONTENT:

• AI recommendations and project plans generated for you

• You may use for personal, non-commercial purposes

• You may not resell or redistribute AI-generated content

Feedback

If you provide feedback or suggestions, we may use them without obligation to compensate you.

AI-Generated Content Disclaimer

Tool and Material Safety

YOU ARE RESPONSIBLE FOR:

11. LIMITATION OF LIABILITY

Maximum Liability

• Damages arising from use or inability to use the App

• Injuries or damages resulting from DIY projects

• Outcomes of following project guides or AI recommendations

MAXIMUM LIABILITY: Our total liability shall not exceed the amount you paid us in the 12 months before the claim (or $100 if greater).

Assumption of Risk

YOU ASSUME ALL RISK when undertaking home improvement projects. You are solely responsible for assessing whether you have the skills, tools, and knowledge to safely complete any project.

Jurisdictions That Don't Allow Limitations

Some jurisdictions don't allow limitation of liability. In those cases, our liability is limited to the greatest extent permitted by law.

• Delete the App from your device

• Cancel subscription in App Store/Play Store settings

Our Right to Terminate

We may suspend or terminate your access:

• For violation of these Terms

• For fraudulent activity

• At our discretion with or without notice

Effect of Termination

• Your right to use the App immediately ceases

• You must delete the App

• Subscriptions continue until canceled in App Store/Play Store

• Sections that should survive termination will survive (warranties, liability, etc.)

14. CHANGES TO TERMS

We may modify these Terms at any time. We will notify you by:

• Posting updated Terms in the App

• Updating the "Last Updated" date

• In-app notification for significant changes

Continued use after changes constitutes acceptance.

If you don't agree with new Terms, stop using the App.

15. GOVERNING LAW AND DISPUTES

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions.

Dispute Resolution

INFORMAL RESOLUTION:

First, contact us at support@homeprojectpro.ai to resolve informally. We commit to working in good faith to resolve disputes.

BINDING ARBITRATION:

If we cannot resolve a dispute informally, you agree that disputes will be resolved by binding arbitration in accordance with the American Arbitration Association's rules. Arbitration will take place in Texas.

EXCEPTIONS TO ARBITRATION:

• You may bring claims in small claims court if they qualify

• Either party may seek injunctive relief in court for intellectual property violations

NO CLASS ACTIONS:

You agree to bring claims individually, not as part of a class action. You waive your right to participate in class actions.

OPT-OUT OF ARBITRATION:

You may opt out of arbitration within 30 days of first using the App by emailing support@homeprojectpro.ai with "Arbitration Opt-Out" in the subject line.

Jurisdiction

For any disputes not subject to arbitration, you agree to jurisdiction in the state and federal courts located in Texas.

16. MISCELLANEOUS

Entire Agreement

These Terms, Privacy Policy, and Refund Policy constitute the entire agreement between you and Reid Graber Studios, LLC.

Severability

If any provision is invalid, the rest remains in effect.

Waiver

Failure to enforce a right doesn't waive that right.

Assignment

You may not assign these Terms. We may assign without restriction.

Force Majeure

We're not liable for delays due to circumstances beyond our control.

If you download from Apple App Store:

• Apple has no obligation to provide support

• Apple not responsible for the App

• In case of third-party claims, we (not Apple) are responsible

• Apple and its subsidiaries are third-party beneficiaries of these Terms

If you download from Google Play:

• You comply with Google Play Terms of Service

• Google is not responsible for the App
